This Privacy Policy describes how we collect and use your personal information when you visit insulacapitalgroup.com (the “Site”), use the chat widget or text messaging on the Site, submit a loan inquiry, or communicate with us electronically.
Please read this policy to understand our practices regarding your personal information. By accessing or using the Site, you agree and consent to this Privacy Policy. If you do not agree with our policies and practices, do not use the Site. This Privacy Policy is subject to and governed by our Terms of Service. We may change this Privacy Policy at any time at our discretion; your continued use of the Site after we make changes is deemed acceptance of those changes, so please check this policy periodically for updates.
1The Information We Collect
We may collect two types of information when you use the Site: personal information and non-personal information (collectively, “Information”).
Personal information refers to data by which you may be personally identified, such as your name, email address, telephone number and mailing address, as well as information you choose to share with us about a financing scenario, such as property addresses, purchase prices, loan amounts, project budgets, entity details and financial information. We collect personal information when you provide it through the chat widget, a web form, email, telephone or text message.
Non-personal information refers to data that does not identify you personally, such as browser type, device type, operating system, referring pages, pages visited and the dates and times of your visits. Like most websites, we may use cookies and similar technologies to collect this information and improve your experience.
If you apply for a loan, we may collect additional information as authorized in your loan application, including information from credit bureaus, public records and other third parties, in accordance with applicable law.
2How We Use Your Information
We use Information about you to:
- Respond to your inquiries and communicate with you about your loan scenario or application.
- Evaluate financing requests, perform underwriting and diligence, and process and service loans.
- Send you information about our loan programs and services, including by text message where you have opted in.
- Improve the Site, our products and our customer service.
- Detect, prevent and address fraud, unauthorized activity and other potentially prohibited or illegal activities.
- Comply with applicable laws, regulations and legal process.
3How We Protect Your Information
We use reasonable administrative, technical and physical safeguards designed to protect the Information we collect against unauthorized access, use, alteration or destruction. Unfortunately, the transmission of information via the internet, chat and mobile platforms is not completely secure, and we cannot guarantee the security of Information transmitted to us; any transmission is at your own risk. We are not responsible for circumvention of any privacy settings or security measures we provide.
4When We Share Your Information
We do not sell your personal information. We may share Information about you as follows:
- With our service providers that perform services on our behalf, including the provider of our chat widget and text messaging services (LeadConnector), website hosting, analytics, and payment and loan-servicing providers.
- With third parties you direct or authorize us to share it with, such as title companies, appraisers and escrow agents involved in a transaction.
- In connection with, or during negotiations of, a merger, financing, sale or other transfer of all or part of our business or assets.
- To comply with any court order, law, subpoena or legal process, or to respond to requests from government or law enforcement.
- To investigate, prevent or take action regarding fraud, illegal activity, situations involving the physical safety of any person, or violations of our Terms of Service.
Mobile numbers and text messaging consent records are used solely by Insula and its text messaging service providers and are not shared with third parties for their own marketing purposes.
5Information From Children
The Site and our services are not directed to children under 18, and we do not knowingly collect personal information from children under 18. If we learn we have collected personal information from a child under 18, we will delete it.
6Links to Other Websites and Services
The Site may contain links to third-party websites and services. Any information you provide on or through those websites and services is collected by the third party and governed by that party’s own privacy policy, not this one. We are not responsible for the content or privacy practices of third-party websites.
7Do Not Track
Some browsers offer a “Do Not Track” signal. Because there is not yet a common understanding of how to interpret these signals, the Site does not currently respond to them.
8Retention of Your Information
We retain Information about you for as long as necessary to fulfill the purposes for which it was collected, including to provide the Services, comply with our legal, recordkeeping and reporting obligations, resolve disputes and enforce our agreements. Retention periods vary depending on the type of Information and the nature of our interaction with you; loan records are retained as required by applicable law.
9Your Legal Rights
Depending on where you live, you may have rights with respect to your personal information, including the right to request access to, correction of, or deletion of your personal information, and the right to opt out of marketing communications.
To exercise any of these rights, contact us using the details in the “How to Contact Us” section below. We may take steps to verify your identity before responding to your request, and we will not discriminate against you for exercising any of these rights.
10California Privacy Rights
This section applies to California residents under the California Consumer Privacy Act, as amended (“CCPA”). Subject to certain exceptions, California residents have the right to: know what personal information we collect, use, disclose and sell; request deletion of their personal information; correct inaccurate personal information; and be free from discrimination for exercising their rights. You may also designate an authorized agent to submit a request on your behalf, subject to verification.
We do not sell or share personal information as those terms are defined by the CCPA. In the preceding 12 months, we have collected and disclosed for business purposes the following categories of personal information: identifiers (such as name, email address, phone number and mailing address); commercial information (such as loan scenarios, property details and transaction records); internet or other similar network activity (such as information about your interaction with the Site); and inferences. We do not knowingly collect sensitive personal information through the Site.
11Other State Privacy Rights
Colorado, Connecticut, Utah and Virginia residents have rights under their respective state privacy laws to confirm whether we process their personal information, and to access, correct, delete, and obtain a portable copy of it, and to opt out of targeted advertising and certain profiling. We do not sell personal information or process it for targeted advertising. To exercise these rights, contact us using the details in the “How to Contact Us” section; if we deny your request, you may appeal by replying to our response and explaining why you believe the denial was incorrect.
12European Privacy Rights
If you are located in the European Economic Area or the United Kingdom, we process your personal information on the following legal bases: your consent (for example, when you opt in to text messages), our legitimate interests (for example, operating and improving the Site and responding to inquiries), performance of a contract or steps prior to a contract (for example, processing a loan application), and compliance with legal obligations.
Subject to applicable law, you have the right to access, rectify, erase, restrict the processing of, object to the processing of, and port your personal information, and to withdraw consent at any time. You may also lodge a complaint with your local supervisory authority. Where personal information is transferred outside the EEA or UK, we rely on appropriate safeguards for the transfer.
13Text Messaging Data
If you opt in to receive text messages, we collect your mobile number, your consent record and the content of your messaging with us. You can withdraw consent at any time by texting “STOP” from the number that received messages. We keep consent records and opt-out requests as required by law, and we do not share mobile numbers with third parties for their own marketing purposes.
14Changes to This Privacy Policy
We may change this Privacy Policy from time to time. If we make changes, we will post the amended policy on the Site and update the “Last updated” date above. Your continued use of the Site after we post changes is deemed acceptance of those changes.
